Important: Kelivon provides pet ownership cost estimation and insurance analysis for informational purposes only. Nothing on this Site constitutes veterinary advice, insurance brokerage, or a recommendation to purchase any specific policy. Breed health data represents population averages and does not predict individual pet outcomes. Always consult a licensed insurance professional before making coverage decisions.

These Terms of Service ("Terms") govern your access to and use of Kelivon (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Kelivon, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Kelivon uses publicly available NAPHIA claims data, OFA/CHIC breed health databases, AVMA demographic data, BLS veterinary CPI data, and actuarial modeling to help pet owners understand lifetime ownership costs and evaluate pet insurance options. The Service provides breed-specific cost projections, Monte Carlo veterinary cost simulations, insurance expected value analysis, and policy optimization. The Service is informational only.

3. Not Veterinary or Insurance Advice

Kelivon is not a licensed insurance broker, agent, or veterinary professional. The cost estimates and insurance analyses provided are based on publicly available data and statistical models. They do not constitute recommendations to purchase, enroll in, or decline any specific insurance policy.

You should always:

  • Verify insurance plan details directly with the insurer before purchasing
  • Consult a licensed insurance professional for personalized advice
  • Consult your veterinarian about your pet's specific health needs
  • Understand that breed health data represents population averages, not individual predictions

4. Data Accuracy Disclaimer

Our cost estimates are derived from NAPHIA claims data, OFA/CHIC breed health databases, BLS veterinary CPI, and AVMA demographic data that are updated on their own schedules. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of data derived from third-party sources.

Cost estimates are probabilistic, not guarantees. Monte Carlo simulations use assumptions about veterinary cost distributions and breed morbidity rates that may not reflect your specific pet's actual future health experience.

5. Permitted Use

You may use the Service for lawful personal or commercial research purposes. You agree not to:

  • Reproduce, resell, or sublicense our analysis outputs without a commercial license
  • Scrape or systematically extract data from the Site beyond API rate limits
  • Represent our data as official veterinary or insurance guidance
  • Attempt to reverse-engineer our optimization algorithms
  • Use the Service to harass, defame, or harm any person or entity

6. Credits and Billing

Kelivon uses a per-report credit system. Credits are purchased as one-time payments (not subscriptions) via Stripe. Single reports cost $9, report packs provide 5 reports for $29, and API credit packs are available for developers. All fees are in U.S. dollars and are non-refundable except as required by applicable law. We may change pricing with 30 days' notice.

7. API Access

API subscribers receive API access subject to rate limits specified in the API documentation. API credentials are non-transferable. You are responsible for securing your API keys. We reserve the right to suspend API access for abuse or excessive usage.

8. Intellectual Property

The Service, including its design, optimization methodology, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright and other intellectual property laws. The underlying industry datasets are used under their respective terms. Our original expression, analysis, and optimization methodology are proprietary.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association.

12. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or prominent Site notice. Continued use after the effective date constitutes acceptance of the revised Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Technology Investments LLC with respect to the Service.
